Terms & Conditions

Welcome to Rush. These Terms & Conditions (“Terms”) are a legal agreement between you and MadePure Media (“MadePure Media,” “we,” “us,” or “our”), the developer of the Rush mobile application (“Rush,” the “App,” or the “Service”). By creating an account or using Rush, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you don’t agree, don’t use the App.

1. Eligibility

You must be at least 17 years old to create a Rush account or use the Service. By registering, you represent that you meet this requirement and that all information you provide, including your date of birth, is accurate. We may ask you to verify your age at any time and may suspend or terminate an account we reasonably believe belongs to someone under 17.

Rush is currently available only to residents of Canada and the United States. Rush is not directed at, and may not be used by, residents of any other jurisdiction, or any jurisdiction where offering an app with simulated wagering mechanics like Rush’s would be unlawful. It’s your responsibility to confirm that using Rush is lawful where you live. You may hold only one Rush account.

2. Rush Is Not Real Money Gambling

This section governs over anything elsewhere in these Terms that could be read to conflict with it.

Rush is an entertainment and fantasy sports prediction app. Everything you wager, win, or lose in Rush is denominated in Credits, a virtual, in app scorekeeping unit that:

• has no cash value and is not currency, a security, or property of any kind;
• cannot be purchased with real money, redeemed for cash, exchanged for anything of value, sold, gifted, or transferred between accounts;
• exists solely to track your standing within the App and can be reset, adjusted, capped, or revoked by us at any time, for any reason, including to correct errors;
• has no guaranteed value, quantity, or availability, and creates no debt or obligation of any kind owed by us to you.

Nothing in Rush constitutes real money gambling, betting, or a game of chance for stakes, and no feature of the App should be relied on as such. If a future version of Rush ever introduces any mechanic involving real money, that mechanic will be governed by separate terms presented to you at that time. These Terms do not authorize any such feature today.

3. Your Account

• You’re responsible for keeping your login credentials confidential and for all activity under your account, whether or not you authorized it.
• Provide accurate registration information (email, display name, date of birth, and, if you sign up with Apple, phone number) and keep it current.
• Notify us promptly at the contact address below if you believe your account has been accessed without your permission.
• You can delete your account at any time from Settings in the App. Deletion is permanent and removes your access to your league history, stats, and Credit balance. See our Privacy Policy for what happens to your data when you do.

4. Leagues, Bets, and Grading

• Rush lets you place personal bets and create or join user run Leagues, each identified by an invite code shared by the league’s commissioner. You’re responsible for whoever you share your invite code with and for how you run a league you commission.
• Odds, scores, and game outcomes used to grade bets come from third party sports data providers. We work to keep this data accurate and timely, but we don’t guarantee it’s error free, complete, or available without interruption, and we’re not responsible for a provider’s mistake, delay, or outage. We may correct, void, or re grade a bet if the underlying data was wrong.
• We may cap the maximum payout on any bet, limit stake sizes, void bets tied to a canceled or suspended game, or otherwise adjust a league or bet to correct an error or address abuse.
• We may take the App fully or partially offline for maintenance without notice. We’re not liable for anything you’re unable to do in the App during downtime.

5. Advertising and Rewarded Ads

Rush is supported by in app advertising, including optional rewarded video ads that grant a fixed Credit bonus for watching. Ads are served by a third party advertising network; see our Privacy Policy for how ad personalization and tracking work and how to opt out. We don’t guarantee that a rewarded ad will always be available, and we may change, limit, or discontinue the rewarded ad feature at any time.

6. Prohibited Conduct

You agree not to:

• create more than one account, or create an account on behalf of someone who isn’t you;
• use bots, scripts, emulators, jailbroken/rooted devices, or any other automated or unauthorized means to access the Service or manipulate your balance, stats, or league standing;
• exploit a bug, glitch, or unintended interaction instead of reporting it to us;
• reverse engineer, decompile, or attempt to extract the source code of the App, except where applicable law gives you the right to do so despite this restriction;
• interfere with, disrupt, or overburden Rush’s servers or infrastructure;
• use the Service for any unlawful purpose, or in a way that harasses, threatens, or abuses another user;
• misrepresent your age or eligibility.

We may suspend or terminate any account that violates this section, at our discretion, with or without notice, and may void Credits or league results connected to the violation.

7. Intellectual Property

Rush’s app, design, logos, and content are owned by MadePure Media or our licensors and protected by intellectual property law. We grant you a limited, personal, non transferable, revocable license to use the App on a device you own or control, for your own non commercial entertainment, subject to these Terms. You get no other rights in the App or its content. If you send us feedback or suggestions, you agree we can use them without any obligation to you.

8. Team and League Names

Rush references real sports leagues, teams, and player names, for example the NFL, NBA, NHL, MLB, WNBA, and NCAAF, and the teams that compete in them, including their names and colors, to identify the real world games Rush covers. This use is purely descriptive. Rush is not affiliated with, endorsed by, sponsored by, or otherwise connected to any league, team, players’ association, or other organization referenced in the App. All team, league, and player names, logos, and colors are the trademarks or property of their respective owners, and appear in Rush only to identify the real world games it covers, not to suggest any partnership, sponsorship, or endorsement.

9. Third Party Services

Rush relies on third party services to operate, including cloud infrastructure and advertising providers, Apple’s Sign in with Apple, and sports data providers. Your use of features built on those services may also be subject to that provider’s own terms. We aren’t responsible for the acts, omissions, or outages of any third party service we don’t control.

10. Apple App Store Terms

This section applies if you downloaded Rush from Apple’s App Store, and reflects terms Apple requires every app with its own end user agreement to include.

• This agreement is between you and MadePure Media only, not Apple. MadePure Media, not Apple, is solely responsible for Rush and its content.
• You may only use Rush on an Apple branded device that you own or control, as permitted by the App Store’s usage rules.
• MadePure Media, not Apple, is responsible for providing any maintenance and support for Rush.
• If Rush fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price for Rush to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for Rush.
• MadePure Media, not Apple, is responsible for addressing any claims relating to Rush or your possession or use of it, including product liability claims, legal compliance claims, and claims under consumer protection law.
• If a third party claims Rush infringes their intellectual property rights, MadePure Media, not Apple, is responsible for investigating, defending, and resolving that claim.
• You represent that you’re not located in a country subject to a U.S. government embargo, and that you’re not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third party beneficiaries of these Terms, and once you accept them, Apple has the right to enforce these Terms against you as a third party beneficiary.

You agree to indemnify and hold MadePure Media harmless from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third party right.

14. Termination

We may suspend or terminate your access to Rush at any time, for any reason, including a violation of these Terms, suspected fraud, or discontinuation of the Service, with or without notice. You may stop using Rush at any time and may delete your account from Settings. Sections of these Terms that by their nature should survive termination (including Sections 2, 8, 10, 11, 12, and 13) will survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we’ll update the “Last Updated” date above and, where required by law, provide additional notice. Continuing to use Rush after a change takes effect means you accept the updated Terms.

16. Force Majeure

We’re not responsible for any delay or failure to perform caused by circumstances beyond our reasonable control, including outages of the third party sports data or cloud infrastructure providers Rush depends on, internet or telecommunications failures, natural disasters, or other events we couldn’t reasonably have planned for.

17. Assignment

You may not assign or transfer these Terms or your Rush account without our written consent. We may assign or transfer these Terms, including to a successor in connection with a merger, acquisition, or sale of assets, without notifying you.

18. No Waiver

If we don’t enforce a provision of these Terms, that doesn’t mean we’ve given up the right to enforce it later.

19. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the rest remain in full force. These Terms, together with our Privacy Policy, are the entire agreement between you and MadePure Media regarding Rush and supersede any prior agreement on the same subject.
